Terms of Service

1. Acceptance of Terms

By accessing or using the Hobbsy marketplace platform (“Service”), operated by Hobbsy, LLC (“Company”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Description of Service

Hobbsy is an online marketplace that connects sellers of handmade, vintage, and craft goods (“Sellers”) with buyers (“Buyers”). We provide the platform and technology to facilitate transactions between Sellers and Buyers but are not a party to any transaction between them.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 18 years of age to create an account. By registering, you represent and warrant that you meet this requirement. Important and private information should be protected by you. Please review our Privacy Policy which sets forth how we handle and use your information. Except as may otherwise be set forth in our Privacy Policy, we are not liable for protection of privacy of electronic mail or other information transferred through the internet or any other network provider that you may use.

4. Buyer Terms

As a Buyer, you acknowledge that:

  • Listings are created and managed by independent Sellers, not by Hobbsy
  • Hobbsy does not guarantee the quality, safety, legality, or accuracy of any listing
  • You are responsible for reading the full listing description before purchasing
  • Payment is processed securely through our third-party payment processor (Stripe)
  • Shipping times and methods are determined by the Seller

Each Seller sets their own return and refund policy, which is displayed on their shop page. Hobbsy encourages Sellers to offer fair return policies but does not mandate a specific policy. If you have a dispute with a Seller, you may open a dispute through the platform and we will facilitate resolution.

5. Seller Terms

As a Seller, you agree to:

  • Provide accurate and complete information about your items, including descriptions, photographs, pricing, and shipping details
  • Only list items that you have the legal right to sell
  • Fulfill orders promptly within the processing time stated in your listing
  • Respond to buyer inquiries in a timely manner
  • Comply with all applicable laws regarding the sale of goods, including consumer protection and tax obligations
  • Maintain valid payment information for receiving payouts

Hobbsy charges a transaction fee of 3% on each completed sale. This fee is deducted from the sale amount before the remaining funds are disbursed to the Seller. Payment processing fees charged by our payment processor (currently Stripe) are also deducted from the Seller’s proceeds; for orders involving multiple Sellers, these processing fees are allocated to each Seller in proportion to that Seller’s share of the order. Fee rates are subject to change with 30 days’ notice.

Sellers may not list items that are: (a) illegal, hazardous, or regulated substances; (b) counterfeit, stolen, or misrepresented goods; (c) infringing on intellectual property rights of any third party; (d) AI-generated art, images, or designs sold as handmade or original human-created work (see our AI Policy for the distinction between AI-assisted tools and AI-generated output); (e) adult, sexually explicit, or pornographic content of any kind, including but not limited to imagery, sculptures, prints, and digital downloads; (f) weapons, ammunition, or explosives; (g) live animals or human remains; (h) items that promote hate, violence, or discrimination. Hobbsy reserves the right to remove any listing and suspend any Seller account that violates this policy. Repeat violations result in permanent account termination.

6. Platform Role

Hobbsy provides a venue for Sellers to offer goods and for Buyers to purchase them. Hobbsy is not a party to the transaction between a Buyer and a Seller. Hobbsy does not manufacture, inspect, store, or ship any products listed on the Service. Sellers are solely responsible for the accuracy of their listings, the quality and safety of their products, and compliance with all applicable laws. Buyers transact with Sellers at their own risk. Hobbsy does not endorse, warrant, or guarantee any product listed on the Service. The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. Company disclaims to the fullest extent permitted by law, all warranties, express or implied, including, but not limited to, warranties of quiet enjoyment and non-infringement and implied warranties of merchantability, fitness for a particular purpose, title, data accuracy, system integration, failure to store, and informational content. Company does not warrant or make any representations regarding the operation of the Service, the use, validity, accuracy, truth, or reliability of the materials within the Service or any other sites linked to this site. Company makes no representations, warranties or guarantees that the Services will meet your requirements or achieve any particular results. Your use of the Services and purchase of third-party products shall be solely at your own risk.

7. User-Generated Content

By uploading, posting, or transmitting any content to the Service — including but not limited to listing photos, descriptions, gallery images, review text, review photos, profile information, messages, and personalization media — you:

  • Represent that you own or have the necessary rights, licenses, and permissions to use and authorize Hobbsy to use such content.
  • Grant Hobbsy a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating, promoting, and improving the Service.
  • Acknowledge that Hobbsy may scan, classify, and analyze your uploaded content using automated tools (including AI detection, content moderation, and copyright-checking systems) and take action based on the results.
  • Agree that Hobbsy is not responsible for the loss or deletion of any content you upload, and that you should maintain your own backups.

8. Intellectual Property

The Service and its original content (excluding user-generated content) are and shall remain the exclusive property of Hobbsy. Sellers retain ownership of their listing content (descriptions, photographs) but grant Hobbsy a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with operating and promoting the Service. Any unauthorized use of any material contained on the Service may violate copyright laws, trademark laws, the laws of privacy and publicity and communications regulations and statutes.

The trademarks, service marks, trade names, and logos (the “Trademarks”) used and displayed on the Service may be registered and unregistered Trademarks of Company or of a third party who has granted the Company permission to use the Trademarks. In addition, all page headers, custom graphics, button icons, and scripts are service marks, trademarks and/or trade dress of Company, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Company. You acknowledge that the Trademarks used and displayed on the Service are and shall remain the sole property of Company or the Trademark owner. Nothing in these Terms shall confer any right of ownership of any of the Trademarks on you. The misuse of the Trademarks displayed on the Service, or any other content on the Service, is strictly prohibited.

9. Content Moderation and Platform Determinations

Hobbsy actively moderates content on the Service to maintain the integrity and safety of the marketplace. Notwithstanding, you acknowledge that the Company does not have any obligation to, pre-screen or monitor any user content, including products or advertisements on the Service, but that the Company and its designees shall have the right, but not the obligation, in its sole discretion, for any reason whatsoever, to post, remove or edit, in whole or in part, any user content, including but not limited to, products, reviews or feedback provided by any user, free or paid advertisements or listings, on or from the Service, or refuse to do the same. The Company and its designees shall have the right to remove any user content that violates these Terms or is otherwise objectionable as determined in the sole and absolute discretion of the Company.

10. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Coordinate with others to mass-report, mass-favorite, mass-review, or otherwise manipulate platform systems
  • Use the messaging system for spam, unsolicited commercial messages, or phishing
  • Harass, threaten, or intimidate other users
  • Post false, misleading, or deceptive content
  • Attempt to gain unauthorized access to other user accounts or platform systems
  • Interfere with or disrupt the Service or servers
  • Circumvent any fees owed to Hobbsy by conducting transactions outside the platform
  • Scrape, crawl, or use automated means to access the Service without permission
  • Manipulate reviews, ratings, or search results
  • File false, misleading, or bad-faith reports, DMCA notices, or disputes against other users

11. Dispute Resolution

If a dispute arises between a buyer and a seller, the parties should first attempt to resolve the issue directly through the platform’s messaging system. If the dispute cannot be resolved, either party may escalate it through Hobbsy’s dispute resolution process. Hobbsy will review the case and may, at its discretion, issue refunds, reverse transactions, or take other appropriate action. Hobbsy’s decisions in the dispute resolution process are final, except where the buyer or seller has independent legal recourse under applicable law. Hobbsy shall not be liable for any products or services provided by third party sellers through the Services.

12. Limitation of Liability

To the maximum extent permitted by law, Hobbsy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service or your purchase of products from third party sellers. This includes, without limitation, damages arising from: content moderation decisions (whether correct or incorrect); the unavailability, defect, or safety issue of any product listed by a seller; the accuracy or completeness of any listing description; or the conduct of any user on or off the platform. Hobbsy’s total liability for any claim arising from the Services and the site shall not exceed the greater of (a) the fees paid by you to Hobbsy in the 12 months preceding the claim, or (b) $100. THESE LIMITATIONS AND EXCLUSIONS APPLY WITHOUT REGARD TO WHETHER THE DAMAGES ARISE FROM (1) BREACH OF CONTRACT, (2) BREACH OF WARRANTY, (3) NEGLIGENCE, OR (4) ANY OTHER CAUSE OF ACTION, TO THE EXTENT SUCH EXCLUSION AND LIMITATIONS ARE NOT PROHIBITED BY APPLICABLE LAW. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS OF USE, OR YOU HAVE ANY OTHER DISPUTE OR CLAIM WITH OR AGAINST HOBBSY WITH RESPECT TO THESE TERMS OR THE SERVICES OR SITE, THEN YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICES AND SITE. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or site must be filed within one (1) year after such claim or cause of action arose or it shall be forever barred.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hobbsy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of: your use of the Service; content you upload or transmit; products you list, sell or purchase; your violation of these Terms; your violation of any third-party rights; or any dispute between you and another user of the Service.

14. Termination

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email (at the address associated with your account) and/or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms. If you do not agree with the changes, you may close your account before the effective date.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland notwithstanding any conflict of laws provisions. You irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the federal courts of Maryland and the state courts located in Howard County, Maryland for any litigation or dispute arising out of or relating to these Terms. You also agree: (i) not to commence any litigation arising out of or relating to these Terms except in the Maryland Courts, (ii) not to plead or claim that such litigation brought therein has been brought in an inconvenient forum, and (iii) agree that the Maryland Courts represent the exclusive jurisdiction for all disputes relating to these Terms and your use of the Service. If you file any action against us and/or our agents, or we file any action against you, and you do not prevail in any such action, you agree to pay the reasonable attorneys' fees and other costs and expenses, including any expert witness fees, incurred by us. You also agree to reimburse us for any fees and expenses, including reasonable attorney’s fees and expert witness fees incurred by us due to your breach of any provision contained herein.

Notwithstanding, if you are located or the violating act occurs, outside of the United States of America, we may elect to proceed by arbitration in our sole and absolute discretion. Upon such election by us, arbitration shall be conducted in Columbia, Maryland by the rules of the American Arbitration Association (the "AAA") or the International Centre for Dispute Resolution ('ICDR'), by a single arbitrator knowledgeable in our industry, and in accordance with the rules thereof then pertaining. This section shall not, in the event arbitration is chosen, prevent us from instituting litigation, in order to obtain standing, and seeking injunctive relief from any United States state or federal court under any law or ordinance or from any other tribunal which may have jurisdiction over the parties.
