Hobbsy Maker Agreement

This Maker Agreement (“Agreement”) governs your relationship with Hobbsy, LLC (“we,” “our,” “us”) as a seller on our marketplace. By checking the maker-attestation box when opening a shop, you agree to every term in this document. If you cannot agree to any term, you must not open a shop on Hobbsy.
1. The Human-Maker Attestation
Hobbsy is a marketplace for goods crafted by human makers. When you open a shop you represent and warrant, on a continuing basis, that:
1.1. Every item you list on Hobbsy is crafted by you, by a member of your human-led small team, or by an identified partner studio whose individual human craftspeople you can name on request.
1.2. You do not list items whose physical form was designed, generated, or rendered by artificial intelligence, machine-learning models, or automated-pattern systems, regardless of whether a human “finished” or “assembled” the output.
1.3. You do not drop-ship, re-sell, or relabel goods produced by third-party factories, contract manufacturers, or print-on-demand services, unless that supply relationship is explicitly disclosed in the listing and falls within the “permitted collaborations” section below.
1.4. Your contribution to every listed item includes meaningful creative or craft work. Operating printing, cutting, or fabrication equipment on designs you did not create does not meet this requirement. The creative value must originate with you or your identified team — not solely from a third-party design file, template, or automated workflow.
1.5. Listing photographs accurately depict the specific item offered for sale. AI-generated, composite, or rendered images that do not depict the actual item are prohibited.
2. Definitions
“Human-made” means the physical object was formed, assembled, finished, or decorated through the intentional work of a named human person, using tools that respond to that person’s judgment. A kiln is a tool; a stable-diffusion model is not.
“Permitted collaborations” means: (a) small human-led studios where you can name every collaborator, (b) local craftspeople operating under your direction, (c) traditional guild or apprentice relationships where the finished work bears the signature of the lead maker.
“Prohibited AI content” means: items whose design, pattern, image, or physical form was generated by a machine-learning model; AI-upscaled or AI-generated product photography; AI-written listing descriptions that misrepresent the provenance of the goods.
3. Your Representations
You represent, warrant, and covenant that, for the entire time your shop is open on Hobbsy:
3.1. The attestation above is true on each day you keep a shop open, not only on the day you opened it.
3.2. You have the legal right to list every item you offer and to use every image you upload.
3.3. You are not listing items that infringe any trademark, copyright, patent, or other intellectual-property right.
3.4. You will cooperate with Hobbsy’s moderation process when a buyer challenges one of your listings under our community-reporting system.
3.5. If you update a listing in a way that substantively changes the item (title, category, or images), you understand that any previously-earned “Verified” badge for that listing is automatically cleared. This prevents item-swap abuse and is a feature, not a bug.
3.6 You are responsible for complying with all international, federal, state and local laws and regulations applicable to the goods and products you offer and sell, including any and all required labels and warnings. Hobbsy shall not be liable and shall assume no responsibility for compliance with any laws and regulations.
3.7 You shall be responsible for protecting any buyer or potential buyer’s personal information you receive or process, and you must comply with all relevant legal requirements. This includes applicable data protection and privacy laws that govern the ways in which you can use personal user information.
3.8 You will not interfere with another user’s shop or sales.
3.9 You shall be responsible for calculating, reporting, and remitting all applicable sales, use, value-added, excise, and similar taxes levied upon the sale of goods.
3.10 You have authorization from Buyer and the right to forward all sale confirmation emails to us for the purpose of parsing and storing information necessary to keep stock counts accurate in the Inventory Hub.
3.11 You shall pay all fees set forth in the most update Terms as and when due.
4. Enforcement and Remedies
If Hobbsy determines, in good faith and after investigation, that you have violated this Agreement, the Terms of Use, Privacy Policy or any other Hobbsy policies:
4.1. Hobbsy may remove the specific listing or listings at issue.
4.2. Hobbsy may suspend your shop for a period ranging from 7 days to permanent, depending on the severity and any prior violations.
4.3. Hobbsy may retain all unpaid platform balances and any pending payouts to offset the cost of investigation and any buyer refunds required.
4.4. Hobbsy may publicly disclose the violation to buyers who purchased affected listings, to the extent required for those buyers’ dispute-resolution rights.
4.5. A knowing, repeated, or commercial-scale violation (for example, drop-shipping AI-generated prints at volume) is grounds for immediate permanent suspension and forfeiture of unpaid balances.
5. Indemnification
You agree to defend, indemnify, and hold harmless Hobbsy, its officers, employees, affiliates, and service providers from and against any claim, demand, loss, damage, cost, or expense (including reasonable attorney’s fees) arising out of or related to your use of the marketplace and site, including but not limited to:
5.1. Any breach by you of this Agreement;
5.2. Any claim by a buyer, third party, or government agency that an item you listed was misrepresented as human-made when it was not;
5.3. Any claims arising out of or related to any products you have listed and/or sold to a buyer;
5.4. Any intellectual-property claim related to your listings or products;
5.5 Any sales or other taxes due as a result of your shop and the sale of your products.
This obligation survives termination of your seller relationship with Hobbsy.
6. Updates to This Agreement
Hobbsy may update this Agreement from time to time. When we publish a new version, we will:
6.1. Send email notice to the email address on file for your account;
6.2. Display a banner on your seller dashboard with a countdown to the acceptance deadline;
6.3. Provide a minimum of 30 days between publication and the soft-enforcement date;
6.4. Provide an opportunity to pre-accept the new version at any time during the grace period.
At the soft-enforcement date, sellers who have not accepted will have their shops removed from Hobbsy’s search results and will be blocked from publishing new listings. In-process orders continue unaffected. At a later hard-enforcement date, sellers who have still not accepted will have their shop pages hidden from public view entirely. All blocks are reversible instantly upon acceptance of the updated Agreement
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland notwithstanding any conflict of laws provisions. You irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the federal courts of Maryland and the state courts located in Howard County, Maryland for any litigation or dispute arising out of or relating to this Agreement. You also agree: (i) not to commence any litigation arising out of or relating to this Agreement except in the Maryland Courts, (ii) not to plead or claim that such litigation brought therein has been brought in an inconvenient forum, and (iii) agree that the Maryland Courts represent the exclusive jurisdiction for all disputes relating to this Agreement. If you file any action against us and/or our agents, or we file any action against you, and you do not prevail in any such action, you agree to pay the reasonable attorneys' fees and other costs and expenses, including any expert witness fees, incurred by us. You also agree to reimburse us for any fees and expenses, including reasonable attorney’s fees and expert witness fees incurred by us due to your breach of any provision contained herein.
Notwithstanding, if you are located or the violating act occurs, outside of the United States of America, we may elect to proceed by arbitration in our sole and absolute discretion. Upon such election by us, arbitration shall be conducted in Columbia, Maryland by the rules of the American Arbitration Association (the "AAA") or the International Centre for Dispute Resolution ('ICDR'), by a single arbitrator knowledgeable in our industry, and in accordance with the rules thereof then pertaining. This section shall not, in the event arbitration is chosen, prevent us from instituting litigation, in order to obtain standing, and seeking injunctive relief from any United States state or federal court under any law or ordinance or from any other tribunal which may have jurisdiction over the parties..
8. Severability
If any provision of this Agreement is held to be unenforceable, the remaining provisions continue in full force, and the unenforceable provision is reformed to the minimum extent necessary to make it enforceable while preserving the parties’ intent.
9. Entire Agreement
This Agreement, together with Hobbsy’s general Terms of Service, Privacy Policy, and any shop-specific settings you have configured, constitutes the entire agreement between you and Hobbsy with respect to your seller relationship. If there are inconsistent terms between this Agreement, the Terms of Service or Privacy Policy the following order of precedence shall apply: this Agreement, Terms of Service, Privacy Policy.
