1. Respect for Intellectual Property
Hobbsy, LLC (“Hobbsy”) respects the intellectual property rights of others and expects all users of our site and services to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to notices of alleged copyright infringement that comply with applicable law.
2. How to File a Takedown Notice
If you believe that content on Hobbsy’s website infringes your copyright, you may submit a DMCA takedown notice to our designated DMCA Agent. Your notice must include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim is infringed.
- Identification of the material on Hobbsy that you claim is infringing, with enough detail for us to locate it (listing URL(s)).
- Your contact information (name, address, telephone number, and email).
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

3. Counter-Notification
If your listing was removed due to a DMCA takedown notice and you believe the removal was a mistake or that you have authorization to use the material, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the person who filed the original notice.
After we receive a valid counter-notification, we will forward it to the original claimant. If the claimant does not file a court action within 10-14 business days, we will restore the removed material.
4. Repeat Infringer Policy
Hobbsy will terminate the accounts of users who are repeat infringers of copyright. We track the number of valid DMCA takedown notices upheld against each seller. Sellers with three or more upheld takedowns are subject to permanent account suspension.
5. Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
